Selectmen Meeting Minutes 7/18/05
The Board of Selectmen held a regular meeting on Monday, July 18, 2005 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 5:00 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Finance Director Ben Spragg, Town Engineer Ron Bolmer

VOTER PARTICIPATION:  None present

COMMUNICATIONS:  First Selectman Rosenthal received letters of appreciation from the Womens Center and from Ability Beyond Disability for funds from the 2005/06 Budget.
        Mr. Spragg distributed copies of proposed revisions to the Capital Improvement Plan.  This will be on the next agenda for discussion.
        Selectman Brimmer received communication from CCM regarding the convention to be held on October 18.
        Selectman Brimmer and Selectman Bojnowski both attended the concert given by the United States Air Force Band on July 14 and reported that it was excellent.  Selectman Brimmer read a proclamation in the absence of the First Selectman.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the 6/22/05 regular meeting were unanimously accepted as presented.

NEW BUSINESS

Driveway Bond Releases/Extensions
Selectman Bojnowski moved to approve the release of five driveway bonds and to grant a six month extension for one driveway bond as outlined on Attachment A.    Motion seconded and unanimously carried.
        
Maintenance Bond Release, Clapboard Ridge Road and a portion of Canterbury Road, “Canterbury Woods Section I” Subdivision
Selectman Brimmer moved to release maintenance bond in the amount of $37,500.00 for Clapboard Ridge Road and a portion of Canterbury Road, “Canterbury Woods Section I” Subdivision.  Motion seconded and unanimously carried.

Maintenance Bond Release, Extension of Canterbury Road, “RE-subdivision Plan, Lots 9 & 12, Canterbury Woods Section II” Subdivision
Selectman Brimmer moved to release maintenance bond in the amount of $13,000.00 for Extension of Canterbury Road, “Re-subdivision Plan, Lots 9 & 12, Canterbury Woods Section II” Subdivision.  Motion seconded and unanimously carried.

Appointments/Reappointments
Selectman Brimmer moved to approve appointments and reappointments as outlined on Attachment B.  Motion seconded and unanimously carried.

Tax Refunds
Selectman Bojnowski moved to approve July 2005 Tax Refunds in the amount of $20,141.54.  Motion seconded and unanimously carried.

Legal Matters – Selectman Brimmer moved to enter executive session to discuss legal matters and to invite Mr. Spragg and the clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 5:20 p.m. and returned to open session at 5:30 p.m.
        Selectman Brimmer moved to approve legal defense in William and Helen Drake vs. ZBA and Frank and Joan Viola vs. ZBA.  Motion seconded and unanimously carried.

ANNOUNCEMENTS:  First Selectman Rosenthal advised that the closing on the purchase of Eichlers Cove Marina will be taking place this week.
        At the next meeting, the Board of Selectman will be appointing members to the Fairfield Hills Authority.  The Ordinance will take effect on July 30, 2005.
        First Selectman Rosenthal advised that it may be necessary to call a special meeting next week to authorize him to sign the O&G contract for project management at Fairfield Hills.

Having no further business, the meeting was adjourned at 5:40 p.m.
